Agreement Making I explores the elements of successful agreements in relation to land access, cultural and heritage protection, environmental management and related economic development initiatives. This program specifically focuses on preparation for agreement making, particularly in relation to the negotiation team and community engagement with the process, as well as options for agreement content. Program presenters will include Ciaran O'Faircheallaigh and Cameron Syme.

Community Liaison Practices

Community Liaison Practices aims to assist NTRB community liaison staff in work with claimants and native title holders. A central focus is expanding your facilitation skills and exploring ways to enhance communication between groups and individuals. 

Activities and small group discussions provide plenty of opportunities for you to learn from colleagues at other NTRBs as well as the presenters, in a relaxed and respectful environment.

Foundations of Native Title

Foundations of Native Title (FoNT) is a three day program designed as an introduction to working in native title and in an NTRB. It provides opportunities for you to acquire and build on the skills and knowledge you need to work in native title, through a range of activities in a supportive environment. It is also a chance for you to connect with and learn from other NTRB staff.

Conflict Management for NTRB Managers Day 2 and 3 will focus on developing skills to manage conflict in the workplace and is open to both managers and HR staff. This will be facilitated by Rhian Williams (please note this will be a different program from Rhian’s portion of the 2012 Management Development Program).

Human Resources Essentials for Managers Day 4 will review core human resources skills and knowledge including: recruiting and interviewing skills; performance appraisals; and EEO, discrimination and harassment. This module will be presented by facilitators from the Macquarie Group and is a repeat of the first day of the 2012 Management Development Program that was held in Perth. This is open to both managers and HR specialists.

Forum for HR Specialists is proposed for Friday morning and would be a facilitated ½ day for HR staff to discuss relevant issues and share experiences.

Native Title Law and Practice provides a review of the key elements of the Native Title Act 1993 (Cwlth) as amended, and significant case law, to assist legal staff in their work at NTRBs. Opportunities for discussion allow you to learn from others and share your insights and experiences. Native Title Law & Practice is presented in partnership with the National Native Title Tribunal.

Topics include:

• Native Title Act processes, including the claim process (with an update on proposed 2009 amendments), consent determinations and alternative settlements
• proof of maintenance of traditional law and custom and connection, including issues of shared country, succession, proof of particular rights and interests), and state/territory connection guidelines
• recognition of native title under the NTA and related issues, such as extinguishment and the operation of beneficial provisions of the NTA such as ss 47-47B and 211
• an overview of the NTA future act regime, including the scope of the provisions and relevant state/territory legislation.

Who can attend

To attend this program you must be employed by an NTRB. Native Title Law and Practice is designed for lawyers with less than two years experience in native title. Space permitting, the program may also be useful for PBC legal staff.

Research Practices

Research Practices is a three day program covering topics of interest to NTRB research staff. Opportunities for discussion allow you to learn from others and share your insights and experiences.  

The 2013 program will include the following topics:

• a focused session on methodologies for investigating kinship with Peter Sutton
• reviewing case law and legislative developments over the past eighteen months and recent experiences with conferences of experts
• exploring approaches to naming traditional owner groups including dealing with historical, regional and disciplinary differences
• preparing native title groups to get the most from heritage work opportunities, and balancing heritage protection and commercial interests.

Participants will also choose one of two concurrent sessions:

• exploring ethical and practical challenges for NTRBs and native title groups undertaking heritage work in WA
• reviewing and providing input to a QSNTS-led project to establish a glossary of terminology for social organisation relevant to the eastern states for use by non-anthropologists working in native title.

Strategic Negotiation is a skills-based program tailored for NTRB negotiators. It provides a framework for negotiation and the tools to become an effective negotiator. The program takes an interests-based approach to enable exploration of all available options, enhancing the likelihood of acceptable outcomes for all parties. Presentations, exercises and small group coaching allow you to develop your negotiation skills.

• understanding the components of a negotiation
• the Seven Elements, a road map for undertaking negotiations
• preparing for a negotiation
• preparing agendas for successful at the table negotiations
• techniques for asking better questions
• managing conflict and breaking deadlocks
• tools for measuring success.

Who can attend

This program is a repeat of Negotiation Skills offered in 2010. To attend, you must be employed by an NTRB. This workshop is modular, each segment builds on the one before and participants often work in pairs or groups which are pre-allocated. This makes it difficult for any person to miss parts of the course.

Understanding Future Acts

Future Acts is a practical program focussing on Subdivision P (the right to negotiate regime) and how that regime is administered by the National Native Title Tribunal. Participants gain an understanding of both the legal requirements and how the process works with opportunities to apply this knowledge to selected case studies. Future Acts is presented in partnership with the National Native Title Tribunal.

Topics include:

• the powers and functions of the National Native Title Tribunal and Federal Court
• identifying the acts to which Subdivision P applies
• the requirements for a s. 29 notice
• the requirements applications under s. 75 – expedited procedure objection application and future act determination application
• the s. 237 criteria for expedited procedure objection applications
• what it means to negotiate in good faith
• the criteria in s. 39 for making a future act determination.

Understanding ILUAs

a program for NTRB legal staff

Understanding ILUAs is a two day practical program focussing on both the technical aspects of Indigenous Land Use Agreements (ILUAs) and the requirements for registration. Using practical case studies, participants will be better able to make informed decisions about whether or not to recommend the use of an ILUA, select the correct type of ILUA and manage the risks relating to the registration process. Understanding ILUAs is presented in partnership with the National Native Title Tribunal.

Topics include:

• the legal requirements for each type of ILUA
• the advantages and disadvantages of using ILUAs in different contexts
• the registration requirements for each type of ILUA
• applying the knowledge gained to a variety of cases.

Note: Negotiation skills and the content of agreements are outside the scope of this workshop, as they are addressed in a separate Aurora program.

Resource Economics

This is a specialised program covering mining, oil and gas economics for NTRB staff involved in negotiations with resources companies. It will focus on understanding the economic and practical drivers of the resources sector, so that you are better able to position your arguments, and find points of leverage in negotiations. 

Specific content for the 2013 program will be decided in consultation with senior NTRB lawyers and expert practitioners. If you are interested in this program, and wish to provide suggestions for program content, please email Aurora's T&PD team.

Program presenters will include Cameron Syme, lead negotiator for the KLC on the Kimberley LNG negotiations. Cameron has represented TO’s from Torres Strait, Queensland and the Kimberley. Cameron has 10 years experience as an accountant for publicly listed companies.  Since 2004 Cameron has been a director of Latro Lawyers in Western Australia.  Cameron has previously worked as Legal Counsel for Shell Development Australia in upstream energy and as a lawyer at a top tier law firm in Melbourne and Perth.

Native Title Law

A modular program for new and mid-level lawyers

Native Title Law consists of two separate modules so NTRB lawyers may choose to attend all, or part, of the program.  It focuses on claims work, and will also consider broader topical issues of interest to NTRB lawyers. 

Module 1 (Monday to Wednesday) provides a review of the key elements of the Native Title Act 1993 (Cwlth) (NTA) as amended. Based on Native Title Law and Practice, it is presented by the NNTT’s Lisa Wright and is aimed at lawyers with less than two years’ native title experience.  More experienced lawyers seeking a NTA refresher are also welcome.

Module 2 (Thursday and Friday) is aimed at new and more experienced NTRB lawyers.  It focuses on legal developments and topical issues from the last twelve months, including key sessions from the 2012 Legal Masterclass.  Presenters include barristers Vance Hughston SC, Tina Jowett and Tom Keely as well as representatives from the Federal Court, NNTT and senior NTRB lawyers.

Module 1:

• Native Title Act processes, including authorisation, application, amendments, consent determinations and alternative settlements
• proof of maintenance of traditional law and custom and connection, including issues of shared country, succession, proof of particular rights and interests, and state/territory connection guidelines
• recognition of native title under the NTA and related issues, such as extinguishment and the operation of beneficial provisions of the NTA such as ss 47-47B and 211.

Module 2:

• ethical considerations for native title lawyers
• legislative update, including the proposed NTA amendments
• case updates, including the Torres Strait Sea Claim
• legal strategies to reduce intra-Indigenous disputes: strike outs and joinder applications
• expert conferences in practice – successes and lessons learned
• the AIATSIS precedents database – update on new developments
